Bariatric Surgery (Gastric Band/Bypass)

Bariatric surgery is a relatively new field of surgery that can be of particular benefit to patients. It is often a last resort option after alternative weight-reduction measures such as diets and plastic surgery have been considered and explored.

Bariatric surgery is complex and sophisticated and is not without significant risks.  A careful assessment is needed as to whether the patient is suitable for such surgery and there should be an examination of all options and a full and frank discussion of risks and potential complications of such surgery.

There are mainly two types of bariatric surgery as follows: –

  • Gastric Band (a silicone band is secured around the upper stomach where the tightness of the band can be regulated, the aim of restriction being to reduce hunger and to provide a feeling of satisfaction after eating a small meal)
  • Gastric Bypass (a small gastric pouch is formed so that food bypasses the stomach and the upper small bowel)

Problems and errors that can occur include the following: –

  • Nerve damage
  • Infections
  • Anaesthetic complications
  • Poor outcome
  • Failure of the procedure

You may have a claim if you have suffered as a result of surgery that was undertaken negligently.  Whether this surgery was undertaken via NHS or private treatment, you are still entitled to a high standard of care. When that standard of care falls below the required standards it can result in additional pain and discomfort. In some cases you may require remedial surgery as a result.

In cases such as these, our medical negligence solicitors that specialise in surgery claims will be able to help you make a claim for compensation.

Our Client Promise

Our expert Medical Negligence Lawyers will be able to advise you on whether you have a good chance of claiming compensation, as well as assessing your claim’s value. All of our initial consultation work is free and the vast majority of claims go on to be funded by a conditional fee agreement (also known as “no win, no fee”).

We pride ourselves on our customer service. As part of our customer promise, we will seek to obtain an early settlement for you. In some cases we are able to obtain interim compensation payments on your behalf that can be used to pay for your continuing care or reduce any financial hardship you may be suffering as a result of your injury. We also aim to ensure that you get all the rehabilitation support that you need.
