An application will first need to be made to the Court for a declaration as to whether or you are the parent of the child.

A declaration of parentage has implications for a child’s rights and the child’s interest should be considered on the making of such an order and the child may be joined to be represented in such an application.

Normally the issues are resolved by DNA testing for paternity or even maternity.  Generally the Courts consider that the interests of justice are best served by ascertaining the truth of paternity/maternity. Where the Court makes a direction for a blood test or other DNA testing sample to be given the Court may draw an inference from any failure to supply that sample as to the truth of paternity/maternity issues
